Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and Dokaz ("Dokaz", "we", "us") governing your use of the Dokaz backup-verification service (the "Service"). By creating an account or using the Service you agree to these Terms. If you are entering into them for an organisation, you confirm you have authority to bind that organisation.
1. The Service
Dokaz periodically restores the database dumps you register into an isolated, ephemeral sandbox, runs the assertions you configure, and produces signed evidence of the result. The Service verifies backups; it does not create them. We may add, change, or remove features over time.
2. Accounts and eligibility
You must provide accurate registration details and keep your credentials confidential. You are responsible for all activity under your account, including that of users you invite. You must be at least 18 years old and able to form a binding contract. We recommend enabling two-factor authentication.
3. Your data and responsibilities
You retain all rights to the database dumps and other content you provide ("Customer Data"). You grant us a limited licence to process Customer Data solely to provide the Service. You are responsible for having the rights to that data, for the lawfulness of the data it contains, and for not registering dumps that you are not authorised to process.
4. Acceptable use
You agree not to misuse the Service: no unlawful content, no infringement of others' rights, no attempts to breach security or access other tenants' data, no probing or load-testing outside your own account, and no use of the Service to build a competing product. We may investigate and act on suspected violations.
5. Fees, billing, and trials
Paid plans are billed monthly in advance through our payment processor, Stripe. Fees are non-refundable except where required by law or expressly stated. We may change pricing on notice effective at your next renewal. A free trial, where offered, may be limited in capacity and converts to no charge if you do not subscribe. You are responsible for applicable taxes.
6. Suspension and termination
You may cancel at any time from Account → Billing; cancellation takes effect at the end of the current billing period. We may suspend or terminate access for material breach, non-payment, or to comply with law, and will give reasonable notice where practicable. On termination you may export your data for 30 days, after which it is deleted in line with our Privacy Policy.
7. Service availability
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. Any service-level commitments apply only where set out in a separate written agreement. We may perform maintenance and will seek to minimise disruption.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Drill results and evidence describe the verification we performed and are not a guarantee about the condition of any production system.
9. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits or data. Our total aggregate liability arising out of or relating to these Terms is limited to the fees you paid for the Service in the 12 months before the event giving rise to the claim.
10. Indemnification
You will defend and indemnify Dokaz against third-party claims arising from your Customer Data or your use of the Service in breach of these Terms, except to the extent caused by us.
11. Changes to these Terms
We may update these Terms. For material changes we will give notice by email or in the application before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the law of the jurisdiction in which the Dokaz operating entity is established, without regard to conflict-of-laws rules, and the courts of that jurisdiction have exclusive jurisdiction over disputes. Nothing in these Terms limits mandatory consumer-protection rights available to you locally.
